General Terms and Conditions of Sale
Article 1 – Introduction and Obligations of the Parties
These General Terms and Conditions, made available to the Buyer for reproduction and retention pursuant to Article 12(3) of Italian Legislative Decree No. 70/2003, govern the distance purchase of products through the website www.maserin.com, owned by Coltellerie Maserin snc, registered with the Pordenone Chamber of Commerce under No. PN 1554 of the Companies Register, with registered office at Via dei Fabbri 19, 33085 Maniago (PN), Italy (hereinafter also referred to as the “Supplier”), VAT No. 00108700931, telephone +39 0427 71335, email: info@maserin.com.
1.2. The Buyer expressly declares that the purchase is made for purposes unrelated to any trade, business or professional activity carried out by the Buyer and undertakes not to resell the purchased products.
1.3. “Online Sales Contract” means the sales agreement concerning movable goods entered into between Coltellerie Maserin snc and the Buyer within the distance-selling system organised by Coltellerie Maserin snc, using the internet as a means of distance communication.
1.4. “Buyer” means the individual consumer who makes the purchase governed by this Contract for purposes unrelated to any trade, business or professional activity that the Buyer may carry out.
1.5. “Supplier” means the party selling the goods covered by this Contract. 1.6. “Website” or “Site” means www.maserin.com.
Article 2 – Acceptance of the Terms and Conditions of Sale
2.1. These General Terms and Conditions shall be effective from the date on which they are published on the Site. Coltellerie Maserin snc may update, supplement or amend them at any time, with effect for the future, and shall communicate any such changes through the pages of the Site. The provisions set out in the introduction form an integral and essential part of this Contract.
2.2. These General Terms and Conditions of Sale must be reviewed online before the purchasing procedure is completed. Submission of the order confirmation therefore implies full knowledge and complete acceptance of these Terms and Conditions. The Buyer is invited to read them carefully and to print and/or save them on another durable medium accessible to the Buyer, including for the purposes of Articles 52 and 53 of Italian Legislative Decree No. 206/2005, the Italian Consumer Code.
2.3. By electronically submitting confirmation of the purchase order, the Buyer unconditionally accepts and undertakes to comply, in dealings with Coltellerie Maserin snc, with the General Terms and Conditions and payment terms set out below. The Buyer declares that they have read and accepted all the information provided in accordance with the legislation referred to above and acknowledges that Coltellerie Maserin snc shall not be bound by any different terms unless agreed in writing in advance.
2.4. Sales transactions involving consumers are governed by the provisions of Italian Legislative Decree No. 206/2005, the Italian Consumer Code.
2.5. These General Terms and Conditions of Sale do not govern sales of products made by third parties that use direct links to www.maserin.com through banners or other hyperlinks. Under no circumstances may Coltellerie Maserin snc be held responsible for services promised by third parties or for e-commerce transactions carried out between its customers and third parties.
2.6. The language available for entering into the Contract with the Supplier is Italian.
Article 3 – Conclusion of the Contract and Purchasing Procedure
3.1. The purchase contract is concluded when the Buyer places an order by completing the relevant forms correctly and expressing consent to the purchase online, following the instructions displayed on screen and, finally, selecting and accepting the boxes marked “ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE” and “PRIVACY POLICY.” After receiving the Buyer’s order, Coltellerie Maserin snc shall send confirmation of receipt by email to the address provided by the customer. The customer is advised to print and retain this email.
3.2. Each order submitted constitutes an offer to purchase the Coltellerie Maserin snc products displayed on the Site. The Contract shall be deemed concluded and effective between the parties only upon fulfilment of the order and issuance of the corresponding invoice or sales receipt. Until that time, the Supplier may refuse the order.
3.3. Should it become impossible, even temporarily, to fulfil an order in whole or in part, Coltellerie Maserin snc shall contact the customer by email to make the necessary arrangements. The customer shall remain entitled to request the full or partial cancellation of the order and the reimbursement of any corresponding amount already paid.
Since orders are subject to product availability and acceptance by the Supplier, the Supplier may, at any time and at its sole discretion, refuse the Buyer’s order where, by way of example and without limitation:
the customer provides incomplete or inaccurate information that makes it impossible to fulfil the order, issue the invoice and/or deliver the goods; Coltellerie Maserin snc does not deliver to post-office boxes;
the products ordered are no longer available on the Site, as specified in Article 5;
the Site contains an error relating to the products ordered, including an error in the price or product description displayed on the Site;
the total value of the order is considered excessively high, based on an assessment carried out on a case-by-case basis at the Supplier’s sole discretion.
In these circumstances, the Buyer shall be entitled to a full refund of any price already paid but shall not be entitled to any further compensation.
3.4. The characteristics of the products are specified in the online catalogue and may be viewed when selecting the products and completing the order, before the order is submitted. Prices, including VAT and all other applicable taxes and duties, are displayed alongside each product in the online catalogue. The total cost of the transaction shall always be disclosed to the customer before the purchase is confirmed.
3.5. The price charged shall be the price displayed next to the product when the order is completed, together with shipping costs and the cost of any additional services selected by the customer, regardless of any subsequent price changes.
Coltellerie Maserin snc reserves the right to change product prices and shipping charges without prior notice. Any new prices shall become effective upon publication on the Site and shall apply to sales made from that time onwards.
3.6. Customers may pay for the goods ordered using the payment methods indicated on the Site.
Article 4 – Delivery
4.1. Coltellerie Maserin snc shall deliver the selected and ordered products to the address provided by the customer, using courier services and in accordance with the procedures set out in the preceding Article.
4.2. When placing the order, the customer may specify a delivery address different from the billing address.
4.3. Purchased goods shall be delivered within a maximum of 30 working days. This period may vary depending on the type of product and stock availability.
The Supplier shall not be held liable for delayed or failed delivery caused by force majeure or unforeseeable circumstances. Delivery times do not include Saturdays, Sundays or public holidays.
They also exclude particular circumstances such as the recipient’s absence, a delivery location that is difficult to reach, or other problems directly attributable to the courier and outside the control of Coltellerie Maserin snc.
4.4. Upon receipt, the customer must verify that the product delivered corresponds to the order placed. Only after completing this check, and without prejudice to the right of withdrawal provided for in Article 9, should the customer sign the delivery documents.
4.5. Coltellerie Maserin snc shall not be responsible for damage to the purchased products or delays in delivery caused by the carrier and shall remain entirely unrelated to the relationship between the carrier and the customer.
4.6. Following the purchase, an invoice shall be issued automatically in electronic format or, alternatively and upon express request, in paper format. A paper invoice shall be placed inside the package.
4.7. Orders are processed from Monday to Friday after payment has been credited.
4.8. Delivery is available within the territory of the Italian Republic.
4.9. The customer or a person appointed by the customer must be present at the recipient’s address specified in the order when the goods are delivered.
Upon delivery by the courier, the customer must check that:
the number of packages delivered corresponds to the number indicated in the transport document;
the packaging is intact and is not damaged, wet or otherwise altered, including its sealing materials.
Any damage to the package and/or the purchased products, or any discrepancy in the number of packages, must be reported immediately by entering a written reservation for inspection on the courier’s proof of delivery.
4.10. Where a package is returned to the premises of Coltellerie Maserin snc or held at the courier’s depot, the customer shall be charged any storage costs incurred by Coltellerie Maserin snc in relation to the courier.
A customer who is unavailable at the time of delivery may contact the courier’s local office to arrange a subsequent delivery or collection from the courier’s premises.
4.11. Coltellerie Maserin snc shall not bear financial responsibility for packages held at the courier’s premises.
A customer who has been unable to arrange a second delivery or collection from the courier’s premises shall be responsible for ensuring that delivery is successfully completed.
4.12. If the courier returns the package to the Supplier because the customer failed to collect it, Coltellerie Maserin snc shall contact the customer regarding possible redelivery and shall request reimbursement of any storage costs, any shipping costs already incurred for returning the package to Coltellerie Maserin snc and any additional costs to be incurred for redelivery to the customer.
Should the customer fail to pay the costs incurred by Coltellerie Maserin snc, fail to contact the company to agree on payment, or fail to respond within a reasonable period of seven days to an email requesting reimbursement, Coltellerie Maserin snc shall retain the uncollected goods as a result of the customer’s failure to fulfil their obligations.
4.13. The Supplier reserves the right to refuse orders from a customer with whom legal proceedings relating to a previous order are pending.
This shall also apply whenever Coltellerie Maserin snc considers a customer unsuitable, including, by way of example, where the customer has previously breached contractual terms relating to online purchases made through www.w-egg.it, or for any other legitimate reason, particularly where the customer has been involved in fraudulent activities of any kind.
Article 5 – Product Availability
5.1. The customer may purchase products under the conditions stated in the electronic catalogue prepared by Coltellerie Maserin snc and in the quantities available in stock. For this purpose, the Supplier shall indicate in real time in its electronic catalogue which products are available, which are unavailable and the applicable dispatch times.
5.2. Coltellerie Maserin snc does not guarantee the continuous availability of products under the conditions offered. Where a product is unavailable after it has been paid for, Coltellerie Maserin snc undertakes to inform the customer promptly and refund the price, without additional charges, within a maximum of 14 calendar days. Coltellerie Maserin snc shall, in any event, contact the customer immediately to offer either a replacement product of equal value or, where several products were purchased, a reduction of the unavailable product’s price from the total order amount.
5.3. In the event of partial unavailability, the customer shall be promptly informed by email and may choose to: A) accept delivery of the available products and receive the currently unavailable item at a later date; B) receive all the products ordered in a single shipment once the entire order is available; or C) remove the temporarily unavailable item from the order, in which case Coltellerie Maserin snc undertakes not to charge the customer the corresponding price.
5.4. Promotional products and special offers may be ordered subject to actual stock availability.
5.5. Coltellerie Maserin snc shall, in any event, be entitled to confirm and/or amend the stated price. Where the final price is excessively higher than the price originally agreed, the customer may withdraw from the Contract before delivery, in which case the Seller shall be required to refund any amount already paid by the customer.
Article 6 – Liability
6.1. Coltellerie Maserin snc accepts no responsibility for disruptions attributable to force majeure events, including accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, civil unrest and other similar events that wholly or partially prevent the Contract from being performed within the agreed time. Except in cases of wilful misconduct or gross negligence, Coltellerie Maserin snc shall also not be responsible for disruptions or malfunctions connected with the use of the internet that are outside its control or the control of any subcontractors.
6.2. Coltellerie Maserin snc shall not be liable to any party or third party for damage, losses or costs arising from the failure to perform the Contract due to any of the circumstances referred to above. The consumer shall only be entitled to reimbursement of the price paid.
6.3. Coltellerie Maserin snc shall not be responsible for any fraudulent or unlawful use by third parties of credit cards, cheques or other means of payment used to pay for purchased products.
At no stage of the purchasing procedure is Coltellerie Maserin snc able to access or obtain the Buyer’s credit-card number. Through a secure connection, the number is transmitted directly to the banking service provider.
Article 7 – Warranties and Customer Support
The Supplier shall be liable for any proven defect or lack of conformity affecting the product and attributable to the Supplier, provided that the defect is reported by registered letter with acknowledgment of receipt to: Coltellerie Maserin snc, Via dei Fabbri 19 33085 Maniago (PN), Italy, VAT No. 00108700931
Telephone: +39 0427 71335, email: info@maserin.com, within two months of the date on which the defect was discovered. No such notification is required if the Supplier has acknowledged the existence of the defect or has concealed it.
With regard to the conformity warranties applicable to purchased products, sales governed by these General Terms and Conditions shall also be subject to the statutory warranties provided by law. In the event that the products delivered do not conform to the Contract, Articles 129, 130, 131 and 132 of Italian Legislative Decree No. 206/2005, the Italian Consumer Code, shall apply.
Article 8 – Customer Obligations
8.1. Once the online purchasing procedure has been completed, the customer undertakes to print and retain these General Terms and Conditions, which the customer will already have reviewed and accepted as a mandatory step in the purchasing process, together with the specifications of the purchased product.
This is intended to ensure full compliance with Italian Legislative Decree No. 206/2005, the Italian Consumer Code, and Italian Legislative Decree No. 70/2003. 70/2003 .
8.2. These General Terms and Conditions may be updated or amended at any time by Coltellerie Maserin snc, which shall communicate any such changes through the Site. Whenever these General Terms and Conditions are amended, the Buyer undertakes to print and retain the amended version.
8.3. The Buyer is strictly prohibited from entering false, invented or fictitious information during the registration process required to initiate the performance of this Contract and the related communications. The personal details and email address entered must be the Buyer’s genuine personal information and must not belong to third parties or be fictitious.
8.4. It is expressly prohibited to create multiple registrations for the same person or to enter the details of third parties. Coltellerie Maserin snc reserves the right to take legal action in response to any breach or abuse, in the interests and for the protection of all consumers.
8.5. The customer shall indemnify and hold Coltellerie Maserin snc harmless from any liability arising from the issuance of incorrect tax documents caused by errors in the information supplied by the customer. The customer shall be solely responsible for entering the information correctly.
Article 9 – Right of Withdrawal
9.1. Pursuant to Articles 52 et seq. of Italian Legislative Decree No. 206/2005, the Buyer may exercise the right of withdrawal by returning the goods received in their original packaging and obtaining reimbursement of the price paid.
9.2. A Buyer who, for any reason, is not satisfied with the purchase may withdraw from the Contract without penalty and without stating a reason within 14 calendar days from the date on which the purchased goods are received. The right of withdrawal must be exercised in compliance with the mandatory conditions established by Coltellerie Maserin snc.
9.3. All costs associated with returning the products shall be borne by the customer, who shall arrange, directly or by another means, for their delivery to the Supplier at: Coltellerie Maserin snc, Via dei Fabbri 19 33085 Maniago (PN), Italy; all items must be returned in the same condition in which they were received, complete with their original packaging and any manuals and/or instruction booklets included in the package and original packaging. The goods may not be returned using any other procedure.
The Buyer shall, however, only be responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and operation.
9.4. To exercise the right of withdrawal, the Buyer must, within the period specified in Article 9.2—14 calendar days from receipt of the purchased goods—send a registered letter with acknowledgment of receipt to:

The registered letter shall be considered to have been sent within the required period where it is delivered to the accepting post office within 14 calendar days of delivery of the goods. Notice may also be sent in advance by email to
sales@maserin.com, provided that the registered letter with acknowledgment of receipt confirming the withdrawal is sent within the following 48 hours.
9.5. Coltellerie Maserin snc shall accept returned goods subject to verifying that the products have been returned in their original condition and original packaging.
Only after this verification shall Coltellerie Maserin snc refund the amount paid by the Buyer for the products, or a different amount where the value of the goods has been reduced as described in Article 9.3. 9.3.
Article 10 – Authorisations
10.1. By completing the relevant section of the Site in order to finalise the purchasing procedure, the customer authorises the Supplier to debit the customer’s account, in favour of Coltellerie Maserin snc, for the total amount displayed as the cost of the online purchase. The entire procedure is carried out through a secure connection directly linked to the bank that owns and operates the online payment service. Coltellerie Maserin snc has no access to that connection.
10.2. Where the Buyer exercises the right of withdrawal in accordance with Article 9 of these General Terms and Conditions, or whenever payment is made but the sale is not subsequently completed, the amount to be refunded shall be credited to the same credit card or other payment method used and expressly specified by the customer.
Article 11 – Termination and Express Termination Clause
11.1. The obligations assumed by the customer under Article 8, “Customer Obligations,” and the requirement that payment be successfully completed are essential obligations.
11.2. The parties therefore expressly agree that the customer’s failure to fulfil even one of these obligations shall result in the automatic termination of the Contract pursuant to Article 1456 of the Italian Civil Code, without the need for a court ruling and without prejudice to the right of Coltellerie Maserin snc to bring legal proceedings to recover any additional damage suffered.
Article 12 – Jurisdiction and Competent Court
12.1. Any dispute relating to the application, performance, interpretation or breach of purchase contracts entered into online through www.maserin.com shall be subject to Italian jurisdiction.
For any matter not expressly governed by these General Terms and Conditions, the provisions of Italian Legislative Decree No. 206/2005 shall apply. 206/2005.
12.2. Without prejudice to the option provided for in Article 13, any dispute between the parties concerning this Contract shall be subject to the jurisdiction of the court of the district in which the Buyer is domiciled, in accordance with applicable law.
Art. 13 – RISOLUZIONE ONLINE DELLE CONTROVERSIE PER I CONSUMATORI
13.1. European Regulation No. 524/2013 established an online platform intended to provide independent, impartial, transparent, effective, rapid and fair out-of-court resolution of online disputes between European consumers and traders. Before pursuing any other judicial remedy, consumers could refer disputes to this alternative dispute-resolution body. The platform was available at the following address: http://ec.europa.eu/consumers/odr/
Article 14 – Processing of Personal Data
Customer data are processed by Coltellerie Maserin snc in accordance with applicable personal-data protection legislation, as further specified in the notice provided in the relevant section entitled “Information pursuant to Article 13 of European Regulation 2016/679.”
